Terms of Service

1. Acceptance of Terms
By accessing or using the Services, you agree to these Terms and any additional policies referenced here.
2. Eligibility
You must be able to form a binding contract under applicable law, or use the Services only under the supervision of a parent, guardian, employer, or other authorized account administrator.
A family account must be opened by an adult (18 or older). Any child added to a family account must be the child of, or in the legal care of, a parent or guardian in that account. A child aged 13 to 17 may use the Services only with a login given to them by that parent or guardian. Children under 13 may not have a login.
3. Account Responsibility
You are responsible for:
- maintaining the confidentiality of your login credentials
- all activity under your account
- keeping your account information accurate
- ensuring only authorized users access your account
Parents and guardians in a family account are also responsible for the people they invite, for the information they add about family members, for the requests they approve or decline, and for keeping private sharing links private. Anyone who has a sharing link can report a location for the person or vehicle it belongs to until the link is turned off or replaced.
4. Service Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
- use the Services to stalk, harass, threaten, abuse, or harm anyone
- impersonate another person or misrepresent authorization
- submit false emergency alerts or misuse safety features
- attempt to bypass security, copy source code, decompile, or reverse engineer the Services
- scrape, crawl, or bulk-extract data without permission
- upload malware or interfere with system integrity
- infringe intellectual property or privacy rights
- use the Services in violation of any law, regulation, or order
5. Safety Disclaimer
The Services are designed to support awareness, communication, and documentation, including limited emergency-only health information such as allergies, medications, critical condition flags, and emergency instructions. They are not a substitute for emergency services, law enforcement, medical care, or professional advice.
The Services are not intended to store detailed medical records such as blood work, surgery history, lab results, or full clinical charts unless a separate approved use case requires them.
If there is an emergency, users should contact the appropriate emergency services immediately. You remain responsible for deciding what information to include and for ensuring the information is accurate and appropriate for emergency use.
6. Alerts and Location Features
Alerts, location updates, check-ins, and notifications depend on device settings, network availability, app permissions, and third-party services. Delivery may be delayed or unavailable. We do not guarantee that any alert, message, or location update will be received, delivered, or acted on in time to prevent harm.
Consent to be located. You may set up location sharing only for yourself, for your own minor child, or for a person who has agreed to it. Each person is asked to agree on their own device before any location is collected. You may not use the Services to locate or follow anyone without their knowledge.
How locations arrive, and their limits. In a web browser, Guardian can report a device's location only while it is open on the screen. All-day location depends on a separate app, OwnTracks, which is made and published by others and is not part of the Services. A vehicle's position comes from a phone or tracker placed in it, or is estimated from the phone of its usual driver; that estimate cannot tell which vehicle the person is actually in. Positions can be inexact, late, or missing.
Warnings are estimates. Warnings such as arriving at or leaving a place, driving over a speed, low battery, a missed check-in, or a phone that has stopped reporting are worked out from the information a device sends. They can be wrong, late, or not raised at all, and they should not be relied on as the only way to know that someone is safe.
SOS. An SOS tells the parents, guardians and other adults in your family account. It does not contact 911, law enforcement, or any emergency service. In an emergency, call 911.
Email and text messages. Alerts are sent by email and, if you opt in, by text message. Text message alerts are optional and are not a condition of buying or using the Services. How many you receive depends on what happens in your family. Message and data rates may apply. Reply STOP to stop at any time, or HELP for help. Mobile carriers are not responsible for delayed or undelivered messages.
7. Subscription and Billing
If you purchase a paid plan, you authorize us and our payment processors to charge the selected payment method according to the applicable pricing, billing cycle, and taxes. We may change pricing or plan features with reasonable notice where required by law or contract.
8. Suspension and Termination
We may suspend or terminate access immediately if we believe:
- the Services are being misused
- a user poses a security, legal, or operational risk
- a payment fails
- required consent is missing
- continued access could harm us, our users, or third parties
9. Intellectual Property
The Services, including all software, interface design, branding, logos, text, graphics, workflows, documentation, and related materials, are owned by VantageIQ or its licensors and are protected by intellectual property laws. Except for the limited license granted to you to use the Services, no rights are transferred to you.
10. User Content
You retain ownership of content you submit, upload, or create within the Services, subject to the license you grant us to host, process, display, reproduce, and transmit that content as needed to operate the Services. You represent that you have the necessary rights and permissions to submit that content.
11. Third-Party Services
The Services may rely on third-party platforms, APIs, or service providers, including map providers (Google, CARTO and OpenStreetMap), email and text message providers (such as Twilio), payment processors, and the OwnTracks tracking app. We are not responsible for third-party downtime, changes, or terms.
12. Disclaimers
The Services are provided "as is" and "as available." We disclaim warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law, VantageIQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption. Our total liability will be limited to the amount paid to us for the Services in the 12 months before the claim, or the minimum amount allowed by law if lower.
14. Indemnification
You agree to defend, indemnify, and hold harmless VantageIQ, its affiliates, officers, employees, and contractors from claims arising out of your use of the Services, your content, your violation of these Terms, or your violation of law or third-party rights.
15. Governing Law
These Terms are governed by the laws of the state in which VantageIQ Technologies LLC is organized, without regard to conflict-of-laws principles.
16. Changes to These Terms
We may update these Terms from time to time. Continued use after the effective date of changes means you accept the updated Terms.
